Understanding Land Transfer Tax in Ontario & Toronto

Ontario Land Transfer Tax

Ontario land transfer tax is a provincial tax payable when ownership of real property is transferred. The tax is calculated on a graduated scale based on the purchase price of the property.

Toronto Municipal Land Transfer Tax

In addition to the provincial tax, properties located within the City of Toronto are subject to municipal land transfer tax. This results in two separate land transfer tax calculations for Toronto properties.

Land Transfer Tax Rebate for First-Time Home Buyers

Eligible first-time home buyers may qualify for:

  • Up to $4,000 rebate on Ontario land transfer tax

  • Up to $4,475 rebate on Toronto municipal land transfer tax​​​​

This rebate will be reduced if one (or more) of the purchaser(s) is not a first‑time homebuyer. The rebate will be proportionate to the interest acquired by the individuals who qualify for the refund

Eligibility Requirements for the Rebate

  • Must be a Canadian citizen or permanent resident

  • Must be 18 years or older

  • Must occupy the home within nine months of purchase

  • Cannot have owned a home anywhere in the world

  • Spouse must not have owned a home while being your spouse

  • Newly constructed homes must qualify for a home warranty

  • Applications must be submitted within 18 months of purchase
